This Policy sets forth the rights and responsibilities of Personal Data Subjects, as well as PredIAct\u2019s duties and commitments regarding its use.<\/p><p>Asimismo, esta Pol\u00edtica establece los principios y par\u00e1metros generales que deben observarse en el tratamiento de datos personales por parte de PredIAct o de terceros que \u00e9ste designe como encargados. En consecuencia, su cumplimiento ser\u00e1 obligatorio para los colaboradores, empleados, contratistas, clientes y dem\u00e1s terceros que traten datos personales para PredIAct.<\/p><p>Data Subjects should consult this Policy or the corresponding Privacy Notice, as applicable, before providing personal information. The provisions of this document apply to the processing of personal data and sensitive personal data provided physically, as well as through non-face-to-face mechanisms (for example, the website www.prediact.com, information systems, emails, etc.) of PredIAct. Therefore, it is recommended that Data Subjects familiarize themselves with these mechanisms before using or contacting PredIAct. If they do not agree with this Policy, Data Subjects should refrain from using the PredIAct website and other information systems or from providing their data to PredIAct.<\/p><h2><strong>4. <\/strong><strong>ALCANCE<\/strong><\/h2><p>La presente Pol\u00edtica ser\u00e1 aplicable al tratamiento de datos de Usuarios del sitio web, proveedores, contratistas, empleados, Clientes persona natural, socios, aliados y\/o terceros cuyos datos personales hayan sido recolectados por PredIAct por cualquier medio en calidad de Responsable del Tratamiento. En consecuencia, la presente pol\u00edtica no aplica cuando PredIAct act\u00fae como Encargado del Tratamiento, en la medida que los datos personales son tratados por cuenta de sus Clientes, conforme a las instrucciones documentadas de estos y a los acuerdos de transmisi\u00f3n de datos personales que correspondan.<\/p><p>Todos los colaboradores de PredIAct observar\u00e1n y guardar\u00e1n esta Pol\u00edtica en el cumplimiento de sus actividades y funciones. De no existir un v\u00ednculo laboral, en los contratos se entender\u00e1 incluida una cl\u00e1usula para que quien act\u00fae en nombre o representaci\u00f3n de PredIAct respete y cumpla esta Pol\u00edtica. De esta forma, este documento tambi\u00e9n ser\u00e1 tanto el manual interno de pol\u00edticas y procedimientos, como la pol\u00edtica de tratamiento de la informaci\u00f3n.<\/p><h2><strong>5. <\/strong><strong>EXCLUSI\u00d3N DE LA POL\u00cdTICA<\/strong><\/h2><p>Cuando PredIAct act\u00fae como Encargado del Tratamiento, la totalidad de los datos personales se realizar\u00e1 bajo las directrices y t\u00e9rminos establecidos en la Pol\u00edtica de Privacidad de Cliente, al ser el Cliente el cliente quien recolecta y gestiona los datos personales los softwares desarrollados por PredIAct.<\/p><p>\u00a0<\/p><p>Cuando PredIAct act\u00faa como un Encargado del Tratamiento (data processor), y no como un Responsable del Tratamiento (data controller), seg\u00fan se definen en las leyes de privacidad aplicables, los Datos personales bajo responsabilidad del Cliente se procesar\u00e1n cifrados, es decir sin acceder a ellos, bajo las instrucciones y en y en nombre del Cliente, sin que PredIAct tenga control sobre las acciones de los Usuarios del Cliente ni el cumplimiento de las normas de datos personales por parte de aquellos. En consecuencia, la Compa\u00f1\u00eda no es responsable por las pr\u00e1cticas de privacidad o seguridad de datos de Cliente.<\/p><p>\u00a0<\/p><p>En desarrollo de su objeto social, PredIAct recolecta informaci\u00f3n p\u00fablica de terceras personas (\u201cDatos Externos\u201d) disponible en internet que puede contener datos personales publicados. Dichos datos son anonimizados y\/o agregados para que puedan ser analizados y unificados con la informaci\u00f3n del Cliente sobre sus Clientes Terceros (\u201cDatos Internos\u201d) por lo que no es posible asociarlos a una persona en particular.<\/p><p>Los Datos Personales anonimizados o agregados podr\u00e1n ser utilizados de manera general en el an\u00e1lisis de los datos personales de los Clientes Terceros, para la creaci\u00f3n de los Datos de PredIAct, entre otros, el Buyer persona, Videos, Im\u00e1genes, captions, insights, resultados sociales, informes de benchmarks entre otros para el uso del Cliente. Los datos personales de los Clientes Terceros est\u00e1n cifrados por lo que PredIAct no tiene acceso a los mismo.<\/p><p>\u00a0<\/p><h2><strong>6. <\/strong><strong>FINALIDADES DEL TRATAMIENTO DE INFORMACI\u00d3N PERSONAL POR PARTE DE PredIAct<\/strong><\/h2><p>Taking into account the different databases of PredIAct, it collects the information of the Holders for the general purposes described below, however, when requesting the prior and express authorization of the holder, the latter will be informed of the specific purposes for which it collects his information in accordance with its corporate purpose.<\/p><p>PredIAct&#039;s objective is the design, development, implementation, marketing, licensing, maintenance, and operation of technological solutions based on artificial intelligence, machine learning, natural language processing (NLP), data analytics, the Internet of Things, among other technologies, aimed at process automation and digital transformation in companies<\/p><p>\u00a0A continuaci\u00f3n, se encuentran las finalidades generales:<\/p><h3><strong>6.1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong><strong>DATOS PERSONALES OBJETO DE TRATAMIENTO<\/strong><\/h3><p>In order to properly carry out its activities and fulfill its corporate purpose, PredIAct will collect Personal Data from Data Subjects, which will be processed for the purposes expressly stated or as set forth in this Policy. In this regard, the Personal Data processed will be that obtained directly from Data Subjects through a commercial, employment, or any other type of relationship with them. PredIAct will obtain the necessary authorization for the data collected and will inform Data Subjects about the data being collected for processing.<\/p><p>In this sense, Personal Data may be obtained through the different channels or formats that are filled out in the establishment of the relationship of the Holders with PredIAct, for example: applications for positions in the company, subscription to the PredIAct website, linking as service providers, through web pages, subscription of documents, among others.<\/p><p>The main Personal Data that may be collected includes the following: name, address and contact information; date of birth; financial information; consumer preferences; and information that allows us to offer better services, among others. In any case, when obtaining the Data Subject&#039;s Authorization, they will be specifically informed about the Personal Data being processed.<\/p><h3><strong>6.2. FINALIDADES DEL TRATAMIENTO DE LOS DATOS PERSONALES TRATADOS POR PredIAct<\/strong><\/h3><h4><strong>6.2.1. Esta informaci\u00f3n podr\u00e1 contener comunicaciones sobre promociones, ofertas, invitaciones, mensajes de bienvenida, encuestas, notificaciones, estudios de mercado, comercializaci\u00f3n de productos y servicios y dem\u00e1s servicios prestados por PredIAct y\/o terceros vinculados, lo anterior para poder mantener informado al titular sobre productos, servicios, novedades, promociones, ofertas, campa\u00f1as, y dem\u00e1s actividades realizadas por PredIAct.<\/li><li>Promote the products and services of PredIAct or its partners with whom it has a business relationship, compile statistical records, and improve PredIAct&#039;s services.<\/li><li>Communicate valuable content such as news, training, updates, and other information about artificial intelligence.<\/li><li>Manage ongoing analysis of customer preferences, consumption habits, tastes, and profiling in statistical aspects, among others.<\/li><li>As well as communicating information generated during administrative, commercial and contact activities to fulfill the corporate purpose of PredIAct.<\/li><li>Report on maintenance windows, service unavailability, or other events.<\/li><li>Permitir el ejercicio de los derechos legales del usuario<\/li><li>Comply with the communication obligations contained in the PredIAct user licenses and terms and conditions.<\/li><\/ol><p>\u00a0<\/p><p>El Titular de los datos al registrarse en el Sitio Web de PredIAct otorgar\u00e1 su consentimiento libre y voluntario para que el tratamiento se realice en los t\u00e9rminos establecidos en el Aviso de Privacidad que se ponga a su disposici\u00f3n. En el entendido de que, si el Usuario decidiera no proporcionar informaci\u00f3n obligatoria, este no podr\u00e1 acceder a los servicios que efectivamente requieren de dicha informaci\u00f3n, sin embargo, podr\u00e1 tener acceso a todos los dem\u00e1s servicios que no requieran dicha informaci\u00f3n.<\/p><p>PredIAct en ning\u00fan caso y bajo ninguna circunstancia recolecta a trav\u00e9s del Sitio Web Datos Personales Sensibles de Clientes Terceros como origen racial o \u00e9tnico, estado de salud actual, informaci\u00f3n gen\u00e9tica, creencias religiosas, filos\u00f3ficas y morales, afiliaci\u00f3n sindical, opiniones pol\u00edticas, preferencia sexual, etc. Frente a sus Clientes, Usuarios, \u00a0proveedores, contratistas y empleados podr\u00e1 recolectar y tratar datos personales de salud y\/o biom\u00e9tricos cuya finalidad ser\u00e1 el cumplimiento de obligaciones legales y de seguridad f\u00edsica en caso de acceder a sus instalaciones. Igualmente, implementa medidas de confidencialidad adecuadas. Esta tecnolog\u00eda cifra, codifica y previene la intercepci\u00f3n de la informaci\u00f3n suministrada por internet. PredIAct establece y mantiene medidas de seguridad administrativas, t\u00e9cnicas y f\u00edsicas que permiten proteger los Datos Personales contra: da\u00f1os, p\u00e9rdida o alteraci\u00f3n, destrucci\u00f3n, o el uso, acceso o tratamiento no autorizado. PredIAct contiene hiperv\u00ednculos o hipertextos \u00ablinks\u00bb, banners, botones y herramientas de b\u00fasqueda en la World Wide Web que al ser oprimidos o utilizados por los usuarios conllevan a otros portales o sitios de Internet propiedad de terceros. No obstante que en algunos casos estos sitios o portales de terceros se encuentran enmarcados con la barra de navegaci\u00f3n o el look &amp; feel de PredIAct, la Informaci\u00f3n que el Titular llegase a proporcionar a trav\u00e9s de esos sitios o portales no se encuentra cubierta o contemplada por esta Pol\u00edtica y su manejo o utilizaci\u00f3n no es responsabilidad de PredIAct, por lo que recomendamos a nuestros usuarios verificar los avisos y Pol\u00edticas de Privacidad desplegadas o aplicables a estos sitios o portales de terceros y dem\u00e1s Bases de Datos tratadas por PredIAct. Igualmente, los Datos Personales de los Titulares podr\u00e1n ser Transmitidos o Transferidos a empresas vinculadas, subordinadas, afiliadas o casa matriz de PredIAct, empresas que podr\u00e1n estar localizadas en pa\u00edses diferentes a Colombia que ofrezcan niveles diferentes de protecci\u00f3n de datos personales a los establecidos en Colombia. La informaci\u00f3n que sea objeto de Transferencia o Transmisi\u00f3n podr\u00e1 ser utilizada para diversos objetivos comerciales, como lo es el proporcionar datos estad\u00edsticos a anunciantes potenciales, enviar publicidad a los usuarios de acuerdo con sus intereses espec\u00edficos, conducir investigaciones de mercadeo, y actividades promocionales y comerciales autorizadas por los Titulare. PredIAct tambi\u00e9n podr\u00e1 revelar informaci\u00f3n cuando por mandato de ley y\/o de autoridad competente le fuere requerido o por considerar de buena fe que dicha revelaci\u00f3n es necesaria para: I) cumplir con procesos legales; II) cumplir con el Convenio del Usuario; III) responder reclamaciones que involucren cualquier Contenido que menoscabe derechos de terceros o; IV) proteger los derechos, la propiedad, o la seguridad de PredIAct, sus Usuarios y el p\u00fablico en general. En cualquier caso, los Avisos de Privacidad o Autorizaciones respectivas, informar\u00e1n al Titular sobre la Transferencia o Transmisi\u00f3n de sus Datos Personales. Consultas<\/strong><\/h3><p>The Holder or their representative may consult the Holder&#039;s personal information provided to PredIAct, for which they must make a request through the means enabled by PredIAct.<\/p><p>PredIAct must respond to the inquiry within a maximum of ten (10) business days from the date of receipt of the inquiry; when it is not possible to respond to the inquiry within said term, the interested party will be informed, stating the reasons for the delay and indicating the date on which their inquiry will be addressed, which in no case may exceed five (5) business days following the expiration of the first term.<\/p><h3><strong>12.2. Reclamos<\/strong><\/h3><p>The Data Subject or their representative may request the correction, updating or deletion, by submitting a claim which must be processed through a written request containing the following information:<\/p><ol><li>Holder Identification<\/li><li>Description of the events that give rise to the claim,<\/li><li>Correspondence address of the Holder.<\/li><li>Supporting documents for the application.<\/li><\/ol><p>PredIAct will require the interested party within five (5) days following receipt of the claim to provide additional documents, in cases where the request is incomplete.<\/p><p>If the applicant fails to submit the required information within two (2) months of the date of the request, the claim will be considered withdrawn. Upon receipt of the claim, a note will be entered into the corresponding database within two (2) days, indicating that the claim is in progress.<\/p><p>PredIAct or the appropriate party will address the claim within fifteen (15) business days from the day following its receipt. If it is not possible to address it within that timeframe, the interested party will be informed of the reasons for the delay, and a response will be provided within a maximum of eight (8) days.<\/p><p>Data subjects may at any time rectify, access, and update their data, including, among other things, data that is partial, inaccurate, incomplete, fragmented, misleading, or whose processing is expressly prohibited or has not been authorized. In accordance with the Law, PredIAct may deny access to Personal Data, the revocation of authorization, or the request for deletion of data in the following cases:<\/p><ol><li>When the applicant is not the Owner of the Personal Data, or the successor, or the legal representative is not duly accredited for this purpose;<\/li><li>When the applicant is not a public or administrative entity in the exercise of its legal functions, or there is no court order.<\/li><li>When the Holder has a legal duty to remain in the database.<\/li><li>When the applicant&#039;s personal data is not found in their database;<\/li><li>When the rights of a third party are violated;<\/li><li>When there is a legal impediment, or a decision by a competent authority, that restricts access to personal data, or does not allow its rectification, cancellation, or opposition; and<\/li><li>When the rectification, cancellation or opposition has been previously carried out.<\/li><\/ol><h2><strong>13. <\/strong><strong>T\u00c9RMINO DE ALMACENAMIENTO DE LA INFORMACI\u00d3N PERSONAL RECOLECTADA POR PredIAct<\/strong><\/h2><p>Cuando la Informaci\u00f3n Personal recolectada deje de ser necesaria para el cumplimiento de las finalidades previstas en la presente Pol\u00edtica, en el respectivo Aviso de Privacidad o en la Autorizaci\u00f3n y en las disposiciones legales y contractuales aplicables, tus Datos Personales ser\u00e1n eliminados de la Base de Datos de PredIAct.<\/p><h2><strong>14. <\/strong><strong>CAMBIOS DE LA POL\u00cdTICA DE TRATAMIENTO DE DATOS DE PredIAct<\/strong><\/h2><p>PredIAct se reserva el derecho de efectuar, modificaciones a la presente Pol\u00edtica, que rige a partir de su publicaci\u00f3n. De conformidad a lo establecido en el art\u00edculo 5 del Decreto 1377 de 2013, compilado en el decreto 1074, cuando se presenten cambios sustanciales, referidos a la identificaci\u00f3n del responsable y a la finalidad del Tratamiento, los cuales afecten el contenido de la autorizaci\u00f3n ser\u00e1 necesario comunicar dichos cambios al Titular.
